Wounded fugitive arrested in Murphys

An Arnold man who walked away from a Modesto hospital in October despite gunshot wounds and an arrest warrant for a parole violation was back in custody Friday in the Calaveras County Jail.

Jimmy "Blake" Terry, 25, of Murphys, was arrested at 2:10 a.m. Friday on the 700 block of Algiers Street in Murphys, on suspicion of fighting in a public place, violating a protective order and violating parole, according to Calaveras County Jail personnel.

The parole hold made Terry ineligible for release on bail, a correctional officer said Monday.

Due to government holidays, no one at the Sheriff's Office with further information about the case could be reached for comment Monday or Tuesday.

Terry was shot by his uncle, Robert Terry, 36, on Oct. 14 at the older man's Rawhide Road home in Arnold, according to the Calaveras County Sheriff's Office.

The Calaveras County District Attorney's Office determined Robert Terry acted in self-defense in firing a shotgun filled with rock salt and did not file charges against him.

According to court documents, Jimmy Terry fled after the shooting, driven by his girlfriend, Crystal Towle, 24, of Murphys, in a chase with Angels Camp police and sheriff's deputies that reached 95 mph.

Caught later that day in Douglas Flat, Terry had to be airlifted to a Modesto hospital for treatment of stomach wounds.

Towle was arrested on suspicion of felony evading a peace officer andmisdemeanor driving with a suspended license. She has pleaded not guilty to those charges and is awaiting trial.

According to Sheriff's Office and California Department of Corrections and Rehabilitation officials, Terry went outside of the hospital to smoke a cigarette on Oct. 22 and never returned.

A state corrections spokesman said afterward that the department had reason to believe Terry was in intensive care and thus did not require an armed guard.
