Tulloch marina contract in jeopardy

Tulloch Reservoir residents are questioning the legality of a building under construction on a small barge on the lake.

As a result, the two-story, steel frame building built without a permit is to be taken down this weekend, according to Tuolumne County officials. Also to be removed is a concrete breakwater that encircles part of the marina.

And because of this matter, Tuolumne County supervisors on Tuesday are to review and possibly revoke marina manager Joe McGrath's concessionaire agreement with the county.

The building and breakwater were built at the Lake Tulloch Campground and Marina, which is owned by the county on south shore property. The structures were built by Merle Holman, who owns Bev's Boat Rental at the marina. Holman pays McGrath for the space.

"You can't build something without a building permit," Tuolumne County Building Official Greg Lamb said. "You have to follow that process if you want to build something there."

Neither McGrath nor Holman could be reached for comment.

According to Lamb, Tulloch residents angry over the building also got mixed messages from the building and planning departments over whether Holman was told to remove the building or just stop further work on it.

Tuolumne County Planner Robin Wood wrote in an e-mail to various Calavera and Tuolumne County residents that Holman, McGrath and the county struck a deal Tuesday morning to allow the structure to stand. Copper Cove resident Jack Cox forwarded the e-mail to The Union Democrat.

But County Counsel Gregory Oliver said today no deal was made and the statement in the e-mail had been retracted.

"All that was decided was that we'd make the area safe while we continued to investigate," said Oliver.

Tuolumne County owns the shoreline property at Tulloch Reservoir where the campground and marina are located. McGrath manages the business through a concessionaire's agreement with the county.

The Tuolumne County Board of Supervisors and Oliver will discuss terminating McGrath's agreement on Tuesday.
