Fired TGH chief gets $92,500

Tuolumne County has settled its dispute with the former administrator of Tuolumne General Hospital.

The Board of Supervisors announced after a closed door session at its Tuesday meeting it had agreed to pay Michael Marini $92,500 "in full payment of all claims against the county," according to a written statement.

Marini, who started work at the county-owned hospital in July 2001, was fired only four months later. He had been the third person to hold the hospital's top position in less than a year.

That position is now held by Michael Woerman, who was hired a week after Marini's departure.

Marini's lawyer, Thomas Trachuk of Oakland, threatened the county in March with legal action if it didn't come forward with Marini's severance package. Marini's dismissal and the subsequent denial of his severance package was a breach of his contract with Tuolumne County, according to Trachuk.

County officials argued that Marini never signed his contract with the county, negating the agreement. Trachuk disagreed.

The contract didn't address payment of professional dues or continuing education reimbursement, Trachuk said, and Marini returned it, asking for those items to be included. Marini insisted he was told by Bill Morse of the county's Human Resources Department the matter would be taken care of. However, Morse never returned the contract to Marini with the changes, said Trachuk, who said there was never any disagreement about the proposed severance package.
