Livezey trial pushed back to Feb. 2 |
The trial of a Valley Springs man charged with second-degree murder previously scheduled for today is now slated for Feb. 2.
James Alison Livezey, 41, is being held in the Calaveras County Jail on $1 million bond, accused in the July 4 beating death of Marvin Brown, 52, at the Sequoia Rose Mobile Home Park in Valley Springs. Prosecutors say Livezey, unprovoked, attacked Brown and broke his neck. Brown died a week later at Mark Twain St. Joseph’s Hospital in San Andreas. Defense counsel for Livezey argued during a preliminary hearing that it was a drug overdose that caused Brown to fall and strike a sharp object in the trailer where he lived, causing his fatal injuries. A pre-trial conference was scheduled at 9 a.m. today in Department 1 of the Calaveras County Superior Court. Ken Foley, Livezey’s San Andreas attorney, is also scheduled to appear on behalf of clients Michael and Michelle Nemee in a federal bankruptcy court case at 10:30 this morning in Modesto. A trial readiness conference in the case is scheduled for Monday with an eight-day trial in the court’s Department 6 to commence on Thursday. |
