Guilty plea in baby’s death

A Jamestown man accused of killing his infant daughter last December pleaded guilty Wednesday to voluntary manslaughter and assault. 

Kevin Michael Boehmer, 26, entered his plea at a trial readiness conference Wednesday morning in Tuolumne County Superior Court, admitting some charges and avoiding potentially harsher charges and penalties. 

 

Boehmer pleaded guilty to voluntary manslaughter, assault likely to cause great bodily injury with an enhancement for assault leading to a coma, and inflicting corporal injury upon a child. All are felony charges. 

The charges account for three separate incidents from the end of November to early December 2012. Boehmer admitted through his plea agreement to have inflicted corporal injury on his daughter, Kalie Boehmer, on or between Nov. 30 and Dec. 3.

Additionally, he admitted to an assault that resulted in great injury and a coma on or about Dec. 4.

Finally, he pleaded guilty to committing voluntary manslaughter on or about Dec. 9. 

He will be sentenced by Judge Eric DuTemple at 1:30 p.m. July 29. The maximum penalty he faces is 26 years in prison, and the minimum is 12 years. 

By pleading guilty, Boehmer avoiding the possibility of 25 years to life in prison if found guilty by a jury. 

Boehmer was arrested Dec. 8, 2012, at Sonora Regional Medical Center, where he had taken his daughter about 9:50 a.m. because she was having difficulty breathing.

Hospital staff noticed several old bruises and injuries around the child’s neck and chest and reported it to the authorities, said Tuolumne County Sheriff’s Sgt. Jeff Wilson.

The girl, 3 months old, was airlifted to Children’s Hospital and Research Center Oakland. She died Dec. 11, leading to an updated charge of assault resulting in death of child under 8 years of age.

Boehmer had recently moved to Tuolumne County from Washington state, where the child’s mother is incarcerated on child cruelty charges, Wilson said.
