Fowler murder trial delayed

A 13-year-old Valley Spring boy accused of murdering his sister will have to keep waiting for his trial.

 The case has been delayed by further evidence gathering and challenges to the admissibility of evidence by the boy’s attorneys.

It is now set to go to trial Sept. 22.

The boy is accused of killing his 8-year-old sister, Leila Fowler, on April 27, 2013, at the Rippon Road home his family rented. The mother and father were away at a Little League game when the incident happened.

The boy told investigators an intruder had killed his sister, sparking a manhunt, but investigators soon focused on the boy as evidence was gathered.

Defense attorneys Mark Reichel and Steve Plesser, of Sacramento, appeared in court Tuesday and requested more time for evidence gathering and testing. Calaveras County Superior Court Assigned Judge Thomas Smith granted it.

The boy made a court appearance with his attorneys, handcuffs shackled to ankle restraints, in a dark plaid button-up shirt. He answered quietly “yes” when asked by Smith if he agreed to waive his right to a speedy trial so his attorney’s could have more time.
