Calaveras will pay $45K in settlement

Calaveras County will pay an Arnold man $45,000 to settle a lawsuit in which he claims a county road maintenance crew “virtually clear-cut” an entire corner of landscaping on his property.

The lawsuit stems from an incident in May 2013, in which road crews arrived in the area of Thomas Cahill’s residence on East Thunderbolt Trail.

Some of the trees and shrubs the county crew cut away were within the county’s right-of-way, which extends 25 feet from the center lines of Thunderbolt Trail and Mustang Road. 

However, “considerable” vegetation was destroyed beyond the right-of-way on Cahill’s property, according to a complaint filed in Calaveras County Superior Court earlier this year. 

Trees destroyed include a 13-inch diameter black oak, more than 30 ponderosa pines, five cedars and three large lilac shrubs. 

Five other trees were stripped of all branches up to 15 feet above the ground, the complaint states.
