Boehmer to stand trial in infant death

A Jamestown man accused of killing his infant daughter waived his right to a preliminary hearing in Tuolumne County Superior Court on Friday.

Kevin Michael Boehmer, 26, decided to forgo the hearing that requires prosecutors to establish probable cause to proceed with their charges.

Judge Eleanor Provost ordered that Boehmer be held to answer to a charge of assault on a child under 8 years old resulting in death.

His public defender, Robert Price, declined to comment on the reason behind waiving the hearing. The preliminary examination was continued twice before Friday’s hearing. 

The child, 3-month-old Kalie Boehmer, was pronounced dead by doctors at Oakland Children’s Hospital on Dec. 11.

The Alameda County Coroner’s Office had not released a cause of death Friday because it was still awaiting toxicology results.

Kalie Boehmer died two days after Boehmer brought her to Sonora Regional Medical Center because she was having difficulty breathing. 

Sonora hospital staff noticed several old bruises and injuries around the child’s neck and chest. They reported it to the Sheriff’s Office, and deputies arrested Boehmer on suspicion of willful cruelty to a child resulting in possible injury or death. He was booked into Tuolumne County Jail.

The Tuolumne County District Attorney’s Office initially charged Boehmer with assault on a child under 8 years old resulting in a coma or paralysis. District Attorney Mike Knowles sought to amend the charge after the infant was pronounced dead.

Provost granted the motion Jan. 9, as well as Knowles’ request to increase bail from $200,000 to $1 million. He remained in custody this morning.

The maximum sentence if convicted is life in prison with the possibility of parole after 25 years, Knowles said.  

Boehmer will be re-arraigned in Superior Court at 1:30 p.m. March 11 in Department 1.
